1. Your Relationship with Thinksplode
1.1 Your use of Thinksplode's website is subject to the terms of a legal agreement between you and Thinksplode. This document explains how the agreement is made up, and sets out some of the terms of that agreement.
1.2 Unless otherwise agreed in writing and/or electronic mail with Thinksplode (at support@thinksplode.com), your agreement with Thinksplode will always include, at a minimum, the terms and conditions set out in this document. This policy is referred to as the “General Use Policy,” or GUP in abbreviation.
1.3 The General Use Policy forms a legally binding agreement between you and Thinksplode in relation to your use of the Services. It is important that you take the time to read the particulars of this agreement carefully. In entirety, this legal agreement is referred to below as the “Terms of Service”, or ToS in abbreviation.
1.4 You acknowledge that Thinksplode is not liable for any consequences of you using its services.
2. Acceptance of Terms
2.1 In order to use the Thinksplode, you must first agree to the ToS. You may not use Thinksplode if you do not accept the ToS.
2.2 Your use of Thinksplode constitutes an inherent acceptance of the Terms of Service. You must understand and agree that Thinksplode will treat your use as acceptance of the Terms of Service from that point onwards.
2.3 You may not use Thinksplode if you are a person barred from use by the administrator or a Thinksplode Representative. This barring of usage will be communicated to you via electronic mail, and will explicitly provide this information for your reference.
2.4 Before you continue, you should print or save a local copy of the General Use Policy for your records.
3. Language of the Terms
3.1 Please understand that the particularities set out in the Terms of Service do not explicitly cover all inappropriate activities during your use of Thinksplode. In other words, simply because an action is not mentioned in the ToS does not mean it is acceptable.
3.2 Thinksplode reserves the right to decide which actions are acceptable and which are not. If you have a question regarding acceptability, please contact Thinksplode via electronic mail at support@thinksplode.com. If you do not contact and gain approval of Thinksplode of a suspicious activity beforehand, Thinksplode additionally reserves the right to lock or disable your account.
4. Provisions of Use
4.1 Thinksplode is constantly developing and attempting to improve services in order to provide the best possible experience for its users. You must acknowledge that the nature of Thinksplode's services and functions may change without prior notice to you, as a user.
4.2 Thinksplode may temporarily or permanently disable your account without prior notice to you. You may stop using Thinksplode at any time. You do not need to specifically inform Thinksplode when you stop using it.
4.3 You must acknowledge that if Thinksplode disables access to your account, you may be prevented from accessing your account details or any files or other content which is contained in, or has originated from, your account.
4.4 You must acknowledge that in the case that Thinksplode modifies the General Use Policy, it is your responsibility, as a user, to follow the updated provisions.
5. Account Security
5.1 You agree and understand that you are responsible for maintaining the confidentiality of passwords associated with any account you use to access Thinksplode.
5.2 Accordingly, you agree that you will be solely responsible to Thinksplode for all activities that occur under your account.
5.3 If you suspect unauthorized use of your Thinksplode account, you agree to contact Thinksplode at support@thinksplode.com.
6. Privacy
6.1 Thinksplode does not provide or make public your personal information to Third Parties. Your information is used only to contact you in cases deemed appropriate by Thinksplode, and will not be marketed.
7. Terminating your relationship with Thinksplode
7.1 The Terms of Service will continue to apply until terminated by either you or Thinksplode defined in the following circumstances:
7.2 If you wish to terminate your legal agreement with Thinksplode, you may do so by contacting Thinksplode via electronic mail at support@thinksplode.com. You must acknowledge that in the case you wish to terminate your legal agreement with Thinksplode, Thinksplode is entitled to, and must, disable your accounts and rescind the services offered to you by use.
7.3 Thinksplode may at any time, and without your prior approval, terminate its legal agreement with you if:
(A) you have breached any provision of the Terms of Service, or
(B) Thinksplode is required to do so by law, or
(C) The provisions of use to you by Thinksplode is, in Thinksplode's opinion, no longer viable or appropriate
8. Intellectual Property
8.1 Thinksplode is by no means responsible for the original source of ideas posted on the website.
8.2 You may not post ideas or content which you have been forbidden from submitting, by a previous or other legal agreement including, but not exclusive to Non Disclosure Agreements (NDAs).
8.3 Thinksplode does not affiliate itself with the content of any ideas, and will not be held responsible for any violations of such agreements. The user which the account belongs to is responsible for violating the terms of not only the prior formed legal agreement, but also Thinksplode's ToS.
8.4 You agree to contact and inform Thinksplode of any known violation of Intellectual Property policies present on the website, so that we may address them promptly and effectively.
9. Copyright Policies
9.1 It is Thinksplode's policy to respond to notices of alleged copyright infringement applicable to intellectual property law (including, in the United States, the Digital Millennium Copyright Act) and to terminate the accounts of infringers.
9.2 If you view, or are exposed to a certain infringement of Thinksplode's intellectual property (all documents on Thinksplode, with the exception of noted particulars are considered Thinksplode's intellectual property), you agree to notify Thinksplode at support@thinksplode.com.
